Terms of Service

1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Radish Retail, LLC ("Radish", "we", "us", "our") governing your use of the Lume mobile application, public share pages, websites, and related services (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you are under 18, you represent that your parent or legal guardian has read these Terms and agreed on your behalf.
2. Eligibility
You must be at least 13 years old to use the Service. Users under 13 are prohibited, and we will terminate accounts we identify as belonging to a child under 13. If you become aware of a user under 13, email privacy@radish.software.
Users between 13 and the age of majority in their jurisdiction may use the Service only with parent or legal guardian consent.
3. Accounts
3.1 Creating an account
You can start with a Supabase anonymous profile or create/sign into a full account with email/password, Apple, or Google. You are responsible for keeping your credentials secure and for activity on your account.
3.2 Account linking and migration
You may convert an anonymous profile into a full account. Lume may migrate scans, score rows, routines, routine completions, cart state, referral claims, and other local state to the linked account.
3.3 Account deletion
You can delete your account in the app or by emailing privacy@radish.software. Deletion removes associated server records and owned storage objects where technically supported, except where retention is required for law, security, fraud prevention, disputes, backups, or transaction records.
4. The Service
4.1 What Lume does
Lume is a skin-wellness tracking app. You capture self-portraits ("Scans"), and Lume analyzes them with AI systems to generate a Lume Score, sub-scores, zone map, apparent Skin Age estimate, quality warnings, trends, routine feedback, product-fit suggestions, and related insights.
4.2 Not medical advice
Lume is not a medical device. Scores, insights, routines, and product suggestions are informational only and are not a substitute for professional medical, dermatological, or mental-health advice. Do not rely on the Service to diagnose, treat, cure, or prevent any condition. Consult a licensed dermatologist for skin concerns.
4.3 Service availability
We provide the Service on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time. Third-party outages, maintenance, bugs, capacity limits, or app-store review requirements may interrupt availability.
5. Subscriptions and Payments
5.1 Free preview and paid access
Lume currently offers a limited free preview experience and paid access through Lume Ultra. The free preview may include one introductory AI scan or other limited functionality. Additional AI scans, advanced scan history, premium analysis, and other paid surfaces may require Ultra or another paid entitlement. Feature sets, limits, and promotional grants may change over time.
5.2 Auto-renewing subscriptions
Lume Ultra subscriptions are auto-renewing and billed through your App Store account at the displayed price and billing period, which may include weekly, yearly, introductory, trial, or promotional offers. Your subscription renews automatically unless canceled through Apple before the end of the current billing period.
5.3 Cancellation and refunds
You can cancel through Apple account subscription settings. Cancellation takes effect at the end of the current billing period. App Store refunds, cancellations, and billing disputes are handled by Apple under Apple's terms; Radish cannot directly issue App Store refunds.
5.4 Trials, introductory offers, price changes, and grants
Trial and introductory eligibility is determined by Apple, RevenueCat, and app configuration. If a trial converts to a paid subscription, you must cancel before conversion to avoid charges. Apple will handle required price-change notices and consents. Promotional or referral Ultra grants may have separate durations, eligibility limits, and abuse controls.
6. Your Content
6.1 What you upload or create
User Content includes Scans, routine entries, notes, share snapshots, product/cart activity you create, and other content you submit through the Service.
6.2 License to operate the Service
You retain ownership of your User Content. You grant Radish a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, display, transmit, and create derivative technical outputs from User Content solely to operate, provide, maintain, secure, and improve the Service for you and other users. We do not sell your Scans and do not use Scans to train publicly released AI models.
6.3 Aggregated and de-identified data
We may create aggregated or de-identified statistics and use them for product improvement, analytics, benchmarking, research, marketing, and business planning, provided the data cannot reasonably identify you.
6.4 Your representations
You represent that you own or have rights to submit your User Content, that it does not violate law or third-party rights, and that any face you scan is your own or belongs to someone who gave explicit consent. Do not scan minors under 13.
7. Public Sharing, Referrals, and Virality Features
Lume may let you create public scan, routine, product, invite, or referral links. Public shares are intended to be visible to anyone with the link and may be accessed by social platforms, crawlers, link-preview services, recipients, and other viewers. Public share snapshots may keep showing the information captured at the time of sharing until the share expires or is deleted where supported.
You are responsible for what you choose to share. Do not share content that you consider private or that you lack rights to share. Referral and promotional grant systems may include limits, fraud checks, eligibility rules, and revocation for abuse.
8. Product Discovery, Retailers, and Affiliate Links
Lume may show products, product-fit scores, product categories, barcode/QR lookup results, cart surfaces, retailer links, prices, images, claims, availability, review counts, and checkout options. Product data can come from third-party catalogs, public product data, retailers, affiliate feeds, AI normalization, or user interactions.
Product names, ingredients, prices, images, reviews, stock status, claims, and retailer availability may be inaccurate, incomplete, or out of date. Always verify product details, ingredients, allergens, suitability, price, shipping, returns, and safety with the retailer or manufacturer before purchase or use.
Retailer links may open Amazon, Sephora, Ulta, Target, Walmart, brand sites, or other third-party destinations. Those third parties are responsible for their own products, checkout, fulfillment, customer service, returns, privacy practices, and terms.
Some links are paid or affiliate links. Radish may earn a commission from qualifying purchases at no additional cost to you. As an Amazon Associate, Radish earns from qualifying purchases. We do not imply that any retailer sponsors, endorses, or controls Lume.
9. Acceptable Use
You may not use the Service to:
- violate any law or regulation;
- upload or scan someone else's face without explicit consent;
- upload or scan minors under 13;
- misrepresent your identity, age, subscription status, or eligibility;
- reverse engineer, decompile, tamper with, or extract source code;
- automate, scrape, overload, or abuse the Service or APIs;
- bypass subscriptions, scan limits, rate limits, referral rules, feature flags, security controls, or entitlement checks;
- interfere with public share links, retailer links, or barcode lookup systems;
- harass, abuse, harm, defame, or mislead another person;
- submit unlawful, infringing, obscene, harmful, or intentionally misleading content;
- resell, sublicense, or commercially exploit the Service without permission.
We may suspend, terminate, rate-limit, or block accounts or devices that violate these Terms.
10. Third-Party Services
The Service integrates with third parties, including Apple, Google, Supabase, RevenueCat, PostHog, Open Beauty Facts, UPCitemdb, Cloudflare, Vercel, retailers, affiliate programs, and social platforms. Your use of third-party services may be governed by their terms and privacy policies. We are not responsible for third-party products, content, policies, outages, prices, fulfillment, refunds, or claims.
11. Intellectual Property
The Service, including the Lume name, Radish name, logos, interface, artwork, copy, code, databases, score systems, product matching logic, share card designs, and underlying technology, is owned by Radish or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable, non-sublicensable license to use the Service for personal, non-commercial use.
If you send feedback, suggestions, or ideas, you grant Radish a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that scores, insights, product matches, barcode results, share links, subscriptions, analytics, product information, prices, retailer availability, or AI outputs are accurate, reliable, complete, safe, or suitable for your purposes. You are solely responsible for decisions you make based on the Service.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADISH, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID RADISH THROUGH THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100.
14. Indemnification
You will defend, indemnify, and hold harmless Radish and its officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your use of the Service, your breach of these Terms, your violation of law, or your violation of third-party rights.
15. Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate access if we believe you violated these Terms, created risk for Radish or others, abused the Service, or if continued access is no longer commercially or legally feasible. Sections intended to survive termination will survive.
16. Governing Law and Dispute Resolution
These Terms are governed by Delaware law, without regard to conflict-of-laws rules.
For U.S. residents, you and Radish agree that disputes arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property infringement.
You and Radish agree that each may bring claims only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, private attorney general, or representative action.
You may opt out of arbitration and the class-action waiver by emailing legal@radish.software within 30 days after first accepting these Terms, with your name, account email if any, and a clear statement that you opt out.
17. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice by email, in-app notice, app update notes, or another reasonable method where required. Your continued use after the effective date means you accept the updated Terms.
18. Miscellaneous
- These Terms and the Privacy Policy are the entire agreement.
- If a provision is invalid, the remaining provisions stay in effect.
- Failure to enforce a provision is not a waiver.
- You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, asset sale, or by operation of law.
- We are not liable for failures caused by events beyond reasonable control.
- You may not use the Service where prohibited by export-control or sanctions laws.
